In 2018, Nintendo continued a legal discharge after several websites that had hawk Nintendo classic video game Roma for people to download. One of these websites is called Romuniverse. This website was commissioned by the Court to pay a summary judgment of $ 2.1 million.
While Nintendo had the summary judgment of the damages he had undergone, he did not have everything he asked the Court. Nintendo had requested a permanent injunction against the site operator, Matthew Storman. At the time, the Offense website had been closed and the courts saw no reason to expect Nintendo would suffer from permanent damages.
The judge supervising the case, Consuelo Marshall Judge, took a second look at the case and now thinks that Nintendo has reasons for receiving the permanent injunction she asked. The new lands come from the fact that Storman has suggested that his website could come back. However, Storman had stated that if his website revived, he would not have Nintendo games.
The Nintendo injunction has been granted prevents copying, distributing, selling or playing unauthorized copies of Nintendo games. In addition, the injunction also barriers to the use of all brands, logos, or Nintendo names, or names in a material that can be interpreted as confusing.
The defendant was also sentenced to definitely destroy all pirated copies of games or other intellectual property. Judge Marshall gave Storman Storm until August 17, 2021 to destroy all games, films, books or unauthorized music Nintendo. However, no indication of how the Court or Nintendo could confirm that the entire Nintendo intellectual property not authorized for the possession of Storman is destroyed.
Romuniverse was not the only pirated game website that Nintendo continued as a judge in 2018. He also continued two well-known websites, including the Loversons and Loveretro. Nintendo was looking for $ 100 million damages in these cases, but finally settled for $ 12.23 million.
